Auto Insurance: Policy Cancellation Overturned

Synopsis of Complaint:

The consumer’s auto insurance policy was cancelled due to non-payment of premium during the Canada-wide postal strike. The consumer lodged a complaint, stating that she was not notified of the policy termination as required under the Insurance Act. The insurer maintained that a cancellation notice had been sent via courier, in accordance with legal requirements. However, the consumer insisted she never received the notice and was only informed of the cancellation after the postal strike had ended. As a result, the cancellation remained on her insurance record, leading to increased auto insurance premiums.

Review by GIO:

The GIO investigated the consumer’s concerns and found that the courier service had attempted to deliver the registered letter to the consumer’s property, however, due to building security restrictions, the courier was unable to access the premises, and no delivery notice was left for the consumer.

Resolution:

Upon reviewing these findings, the insurer reversed the policy cancellation for nonpayment and reissued the consumer’s auto insurance policy without any negative impact from the prior cancellation.
